Man sentenced for child porn

Freeborn County District Court Judge Steve Schwab on Monday sentenced a 19-year-old Albert Lea man to probation for possessing child pornography on his cell phone back in May.
Richard Alan Ferguson Jr. will be on probation for two years. He was also sentenced to 30 days in jail, but because he has already served more than two-thirds of this time after he was arrested, he will not have to serve any additional time.
The sentence came after Ferguson pleaded guilty in October to the charge as part of a plea agreement between his public defender Stephen Erickson and the Freeborn County Attorney’s Office. Under the agreement, the charge was reduced from a felony to a gross misdemeanor.
If Ferguson is amenable to probation, the charge will be further reduced from a gross misdemeanor to a misdemeanor.
Ferguson is also required to complete sex-offender treatment and register as a sex offender.
He is to have no private or unsupervised contact with anyone under 16 except for at work, where he’s living or in public places.
Ferguson reportedly took photos of the website Tagged.com while at the Albert Lea Public Library.
