Albert Lea man sentenced to 20 years in prison for criminal sexual conduct

During the sentencing hearing of her ex-husband Wednesday in Freeborn County District Court, Emma Guerrero directly addressed the man convicted of molesting a family member. 

“You are truly evil,” she told Hector Guerrero. “You, Hector, are a pedophile.”

Guerrero, 56, of Albert Lea was later sentenced to 20 years in prison for second-degree criminal sexual conduct and 20 years in prison for third-degree criminal sexual conduct. The sentences will run concurrently.

On each count, he was given credit for 187 days served and will be on conditional release for 99 years after he is released.

The sentence issued by Judge Steven Schwab exceeded the top of the box of the pre-sentence recommendations for both charges.

In issuing the longer sentences, Schwab found Guerrero had a dominant position to the victim and the victim could have been vulnerable, said Hector Guerrero’s lawyer, Terry Watkins.

In addition, Schwab sentenced Guerrero to four years in prison on a separate charge of second-degree criminal sexual conduct, 8 1/2 years in prison for fourth-degree criminal sexual conduct, 10 years in prison for a second charge of fourth-degree criminal sexual conduct and 2 1/2 years in prison on each of the two charges Guerrero faced for using drugs to injure or facilitate a crime.

Those sentences will all run concurrently with the 20-year sentence.

Guerrero was found guilty after a weeklong jury trial last August.

The incidents reportedly occurred between August 2007 and March 2015, and the victim was 11 years old when the incidents began.
