Driver sentenced in pizza assault

An accomplice of a robbery on a pizza delivery driver was sentenced to 30 days in jail, 30 days in the Sentence to Serve (STS) program or 240 hours of community service, and $40,000 for restitution Monday.
Sandra A. Banuelos, 19, of Albert Lea, was charged with first-degree aiding and abetting aggravated robbery in connection with the assault on a Domino’s Pizza delivery person in May 2002.
Banuelos, Jason Sokolofsky, Juan Miguel Sanchez and two juveniles were accused of playing parts in the attack on Nicholas Joseph Nesse in a driveway near 106 W. 11th St. and stole $16.10 and a pizza.
Banuelos made two phone calls to order a pizza from a pay phone at a gas station and drove the other men to a spot near the delivery address she gave the business. She did not get out of the car during the robbery.
Banuelos said she was not aware the driver would be assaulted. But, Judge James Broberg did not allow a downward departure from the sentencing guideline and ordered a stayed sentence of one year and a day in prison with a five-year probation period.
Of the other suspects, Sokolofsky has already pleaded guility and received a stayed sentence of one year and a day in prison and 27 days of STS, and Sanchez is holding out for a trial.
Nesse was hit in his head with an axe handle, fracturing his skull. He lost partial peripheral vision in his left eye, and his sense of taste and smell, according to the complaint.
The restitution is part of the criminal charge to cover Nesse’s medical expenses. All of the five suspects will be responsible for the restitution if convicted.
