If Anthony Carl Dugstad, 27, violates his probation he could face up to eight years and seven months in prison.

The sentence, by Freeborn County District Court Judge Ross Leuning, calls for Dugstad to complete chemical dependency treatment through Minnesota Adult and Teen Challenge as well as 80 hours of Sentence to Service.

The sentence was a departure from the presumptive sentence under the Minnesota sentencing guidelines, which called for prison time.

Assistant Freeborn County Attorney David Walker said the Minnesota Department of Corrections recommended departing from the guidelines based on Dugstad’s perceived amenability to probation.

Court documents state the meth sale took place Nov. 29 at a storage shed in Albert Lea.

He sold about 10.1 grams of the drug.
