Three men tied to alleged assaults earlier this month appeared in Freeborn County District Court on Monday on their charges. Two were with a public defender, and one was not.
Their omnibus hearings — which will be the next process in the court proceedings were set.
Gilo Otor Gilo
The first man, Gilo Otor Gilo, 18, of Austin, appeared with public defender Stephen Erickson. Erickson requested a default omnibus for his client.
Gilo posted a $25,000 conditional bond and was not in custody. He sat with his sister before walking up to the table with Erickson.
He faces charges of second-degree assault with a dangerous weapon, possessing a firearm that was not identified by a serial number, and carrying or possessing a pistol without a permit.
The charges stemmed from an incident July 12, when a 25-year-old man was allegedly beat unconscious and threatened with a loaded handgun on S.E. Marshall in Albert Lea.
Court documents state Gilo allegedly pulled a gun from the waistband of his shorts and pointed the gun at the man. The handgun seized had its serial number scratched off of it, and Gilo had no permit to carry the handgun, records state.
Kim James Gatlauk
The second man, Kim James Gatlauk, 20, of Mankato, who faces third-degree assault tied to the same incident, appeared in custody with public defender Kevin Rhea.
Gatlauk allegedly kicked the 25-year-old man in the face and hit him with his fists.
Rhea said Gatlauk is unable to post $25,000 conditional bail and requested that Judge John A. Chesterman reconsider the bail amount.
Freeborn County Attorney Craig Nelson said given what he knows, he considers Gatlauk to be a public safety concern.
Chesterman ruled to leave the bail as set, and as a result, Rhea requested a speedy contested omnibus hearing. The date for that hearing has not been set.
Unconditional bail is still $75,000, while conditional bail is $25,000.
Marco Antonio Morales
The third man, Marco Antonio Morales, 37, who faces four counts of assault in connection with the alleged slashing of a woman’s neck on July 15, appeared in-custody without a lawyer.
Chesterman said Morales’ application for a public defender was denied because of his income through his employment at Cargill.
Morales said he lost his job and wanted to reapply for a public defender.
A default omnibus hearing was set for him on Aug. 10 at 1 p.m.
Morales remains in the Freeborn County jail with unconditional bail at $1 million and conditional bail at $600,000.
