An Albert Lea man charged with two felonies after allegedly strangling a woman last May was found not guilty Thursday in Freeborn County District Court.
Carl Preston Douglas, 48, was charged with domestic assault by strangulation and terroristic threats. He was found not guilty on the third day of a jury trial.
Court documents state Douglas was charged after the alleged victim — who was known to Douglas — accused him of grabbing her by the throat and squeezing, causing her to have pain in her neck and have trouble breathing May 24, 2017. She alleged Douglas threatened to kill her during the incident, and she said there were previous domestic violence incidents.
Assistant Freeborn County Attorney Abigail Lambert said the jury did not find Douglas’ guilt was proven beyond a reasonable doubt.
“It was a he-said, she-said situation,” she said.
Lambert said she still believes the alleged victim in the case.
“That’s why I went forward with the prosecution,” she said. “I believe the victim, and I believe her story.”
Douglas has a pending case with the city of Albert Lea regarding an alleged violation of an order for protection.
Defense lawyer Grant Sanders thanked jurors for serving.
“I appreciate the fact that they took time away from their other responsibilities to decide this case,” he said. “After nearly a year, Mr. Douglas is happy to no longer have to worry about this case.”
