The medical malpractice lawsuit filed last year against retired OB-GYN Stephen Thorn, who retired from Mercy Medical Center-North Iowa last May, has been dismissed.

The dismissal was filed Jan. 30 in Cerro Gordo County District Court.

Terra Gaffney, a Rockwell, Iowa, resident, had accused Thorne in the lawsuit of committing an “unconsented and not medically indicated physical touching” of her during a prenatal visit on Oct. 4, 2017.

In addition, Thorne was accused, along with other unidentified females, in the lawsuit, of making “disparaging remarks about Terra Gaffney’s mental health, past medical treatment, the paternity of her unborn fetus and health of Terra Gaffney’s unborn fetus.”

The lawsuit also listed Mercy Medical Center-North Iowa and its Gynecology Clinic as defendants.

Thorn delivered more than 7,000 babies in his career. He began working at Mercy in 2012, after more than 20 years of experience as a doctor in Albert Lea.

Gaffney’s lawyer, Molly Hamilton, said Thursday she could not comment on the circumstances that led to the dismissal and declined further comment.

A phone call to Thorn was not returned as of press time.
