School board accepts resignation of former middle school teacher facing charges

The Albert Lea school board on Monday accepted the resignation of the Southwest Middle School teacher accused of soliciting a 15-year-old student for sex during the 2023-24 school year.
Gerardo Guerrero, 31, had been placed on paid administrative leave after his arrest Nov. 6, and his name was included in the staff movement list that came before the board in its Monday meeting. The list includes new appointments, extra duties assigned to teachers, as well as resignations, retirements and terminations.
The district confirmed his was a resignation that was effective Monday, Nov. 18.
A question about whether Guerrero had been on paid leave since his arrest has not yet been answered by the district.
There has also been no discussion about the issue, either in open or closed session at school board meetings.
Gerardo Guerrero, 31, of Austin was charged with one count of soliciting a child to engage in sexual conduct and one count of distributing via electronic communication material that relates or describes sexual conduct to a child, both felonies.
Court documents allege he met the student when she handed out cupcakes to teachers at Albert Lea High School one day and then tracked her down on Instagram and Snapchat and began sending photos and at least one video that were sexual in nature.
He is next slated to appear in court Dec. 19.
