Man accused of child abuse

A 28-year-old Geneva man made his first appearance in Freeborn County District Court on Wednesday on allegations that he physically abused his 3-month-old child, leading to severe brain injuries.

According to court documents, Cory Craig Bailey is accused of abusive head trauma to his son that was so serious that the baby’s development and functioning level will likely remain that of an infant for the rest of his life.

Bailey is also accused of depriving the baby, now 8 months old, of necessary health care after the alleged incident.

“(The baby’s) ability to develop and function has been severely limited by the injuries inflicted,” the court complaint states. “(He) has serious vision problems or will be blind. It is anticipated that (he) will never be able to walk … He will require special services, occupational and physical therapies, ongoing medical care, numerous medications and will need someone to provide for his personal care needs.”

Bailey faces six felonies tied to the allegations:

one count of first-degree assault, one count of child endangerment, three counts of malicious punishment of a child and one of child neglect.

The incident was reported to authorities by a social worker at St. Marys Hospital in Rochester, after the baby was brought into the emergency room at the request of the baby’s mother on Jan. 11.

The incident is believed to have happened sometime between Dec. 28, 2010, and Jan. 11, while the baby’s mother was at work.

Bailey reportedly told police that the baby’s head hit a door frame while he was carrying the child and walking through a door, but medical professionals have stated the injuries were too serious to have been caused in this manner. Court documents state the baby’s injuries are consistent with “non-accidental trauma.”

The baby was treated for at least a month at St. Marys Hospital in Rochester before being released to his mother. He was considered to be in critical condition until Feb. 7 and had been placed in a medically-induced coma because of large seizures.

In court on Wednesday, Freeborn County District Court Judge Steve Schwab gave Bailey two options: that he be held on $100,000 unconditional bail or that he may choose instead to be allowed to return at the next hearing on his personal promise to appear if he followed some conditions.

Conditions included signing a waiver of extradition, adhering to a safety plan already approved by the court, not living at the home with the baby, complying with random drug tests and not using any illicit drugs or alcohol while the matter is pending. He must also obey the law and not leave the state without prior court permission.

He is only allowed to see the baby and his other child through supervised visits.

Bailey is next scheduled to appear in court at 1:30 p.m. July 18.
